The civil liability of GADDEX For the services provided it is limited to the amount of the same, the user waives claiming any responsibility to GADDEX for any reason in any case of dissatisfaction with the services purchased in the application, as well as possible failures, slow access or access errors, including loss of data or other type of information that may exist on the computer or network of the user accessing it.
GADDEX is a company specialized in the sale of activities for companies focused on Team Building and/or renting premises for activities for companies focused on Team Building remotely via its application. GADDEX he is not the one who will provide the service or who will make the rental, he is an intermediary between users registered in any of the modalities indicated in the privacy policy of the application and the providers of the services, so he has no responsibility for the service offered by the provider.
2.1 Scope of application: The purpose of this contract is to regulate the purchase-sale contractual relationship created between the provider and the user at the time the user accepts these purchase conditions during the online contracting process by checking the corresponding box. These GTC will apply from the day the order is placed.
The contractual purchase-sale relationship involves the provision, in exchange for a specified price and publicly displayed through the application, of a specific service and/or the rental of a place.
2.2 Territory of application: The virtual store of GADDEX It is active for all of Spain.
2.3 Ability to hire: In order to purchase any of the services, you must first be a registered user in any of the modalities detailed in the application's privacy policy, be of legal age and have the capacity to contract.
2.4 Customer Acceptance: The validation of a reservation through the Gaddex application is carried out by email and also implies the automatic acceptance of the GTC. These conditions are available at www.gaddexapp.com or, if you wish and request, we can make them available to you by email.
2.5. Modification of the General Contracting Conditions: GADDEX reserves the right to make changes and/or modifications to these GTC. We advise our customers to check them regularly. In the event that these changes or modifications are introduced after a reservation has been made, the conditions in force on the date on which the reservation was made will apply.
3.1 Publication of prices: The prices of the services are those shown in each one in our application.
All the prices shown in the store include the current VAT and, in the case of activities, the compulsory insurance at the time of purchase. All prices included in the application are valid except for typographical errors and will in any case be expressed in the Euro currency (€).
In the case of limited-duration promotions, the promotion discount will apply as long as the order has been registered during the promotion period.
The data recorded by the different payment methods constitute proof of the date on which the financial transactions were made and will serve to determine whether or not said order is subject to promotion.
3.2 Service Information: The information contained in our advertising, brochures, other written material, on our website, application or that provided by our agents or employees constitutes an invitation to make a purchase. This information does not constitute an offer to perform any service on our part.
The contents of the application are constantly being renewed and updated to provide our customers with the most complete and detailed information possible. Because of this, it is possible that the contents may show, on exceptional occasions, provisional information about some services. If the information provided does not match the characteristics of the service, the customer will have the right to cancel their purchase at no cost on their part.
All contractual information present in the application is displayed in Spanish (Spanish) and communication with customers and users, as well as the formalization of the contract, will be carried out in this language.
3.3 Availability of the service (s): GADDEX has its services available according to the schedules published in the application for each of them. The service must be purchased for a specific day and time.
In the event that the supplier cannot provide the service, taking into account the provisions of section “7. Right of withdrawal and cancellation” of these general conditions of contract, you will be offered two alternatives:

3.4 Order processing and validation: The purchase through the application constitutes an act of irrevocable acceptance of these conditions, and can only be challenged in the limited cases provided for in them. Consequently, GADDEX in no case can it be considered responsible for the non-execution or malexecution of the contracted services, due to the entry of the data of the individual User.
3.5 Orders 24 hours a day, 365 days a year: The reception of orders is twenty-four (24) hours a day, 365 days a year. The customer receives a confirmation email, as soon as the order is processed, with proof of payment, and service information.
3.6 Fraud: if GADDEX If you suspect or detect any anomaly or fraud, we reserve the right to cancel the transaction for security reasons.
In order to access the services offered by the provider, the user must register by creating a user account. To do this, the user must freely and voluntarily provide the personal data that will be required of him.
The user will select a password, undertaking to make diligent use of it, and not to make it available to third parties, and to notify the provider of the loss or theft of the password or of possible access by an unauthorized third party, so that the latter will block it immediately.

The User has rights and deadlines to proceed with the return and/or to claim any possible defects or defects in the service.
The right of withdrawal will not apply according to article 103, paragraph l) of Law 3/2014, of March 27, which modifies the consolidated text of the General Law for the Defense of Consumers and Users to contracts that refer to the supply of services related to leisure activities, if the contracts provide for a specific date or period of execution. If the provider must cancel any of the services, the user may choose to return them or to change the date. In this second case, it will depend on the availability of the provider.
The provider will not be responsible for any non-compliance due to unforeseen circumstances or for causes beyond the control of GADDEX, including, but not limited to, cases of force majeure, riots, embargoes, acts of civil or military authorities, fires, floods, accidents, strikes, lockouts or shortages of transportation, facilities, fuel, energy, labor or materials.
In the event of a delay, GADDEX may be excused from benefits, to the extent that they are delayed or prevented for such reasons, and for the entire period of time in question.
If any clause included in these General Conditions is declared, in whole or in part, null or ineffective, such nullity or ineffectiveness will affect only that provision or the part of it that is null or ineffective, with the General Conditions remaining in everything else, with such provision, or the part of it that is affected, for not being placed.
In accordance with Art. 14.1 of Regulation (EU) 524/2013, the European Commission provides a free access platform for the resolution of online disputes between the USER and the PROVIDER, without the need to go to the courts of law, through the intervention of a third party, called Dispute resolution body, which acts as an intermediary between the two. This body is neutral and will dialogue with both parties to reach an agreement, and may finally suggest and/or impose a solution to the conflict. These conditions will be governed or interpreted in accordance with Spanish legislation where not expressly established. The provider and the user, They agree submit any controversy that may arise from the provision of the service subject to these Conditions, to the Courts and Tribunals of the provider's address (if he is not considered a consumer for the purposes of the TRLGDCU) or the user (if he is considered a consumer for the purposes of the TRLGDCU).
